A US federal appeals court in San Francisco has reopened a lawsuit against Rio Tinto, accusing the company of being complicit in genocide and war crimes at the site of its former Panguna copper mine in Bougainville, Papua New Guinea.

The case is being brought by law firm Hagens Berman on behalf of the residents of the island of Bougainville, who allege Rio Tinto worked with the PNG government to destroy their culture and commit genocide.

"The complaint alleges purposeful conduct undertaken by Rio Tinto with the intent to assist in the commission of violence, injury, and death, to the degree necessary to keep its mines open," presiding Judge Mary Schroeder wrote.

The Panguna copper mine (53% owned by Rio Tinto) was forced to close in 1989.
